It appears that the applicant <br />submitting notice of intent to explore the first 1000 feet of the <br />two mine portals will do mine rehabilitation work including <br />removal of coal and supporting/bolting the roof and walls as <br />necessary. This extensive type of work would be considered as <br />mining activity to which the Federal Mine Safety and Health Act <br />of 19'7'7 and Title 30 Code of Federal Regulations would apply. As <br />such, the applicant should be advised to contact this office and <br />submit the required plans and documents to activate the Burnwell <br />Mine and conduct rehabilitation work. It should be noted that <br />serious and fatal accidents have occurred at abandoned coal mines <br />over the years and proper precautions must be taken to safely <br />explore and rehabilitate the Burnwell Mine. <br />Please contact me at 303-231-5458 if there are any further <br />questions regarding this matter. <br />Sincerely yours, <br />Al n C.
