Payne: <br />On November 17, 2001, our office received a letter from you voicing some concerns and <br />objections to the 110 construction materials application for the Orlando Pit which is located iri <br />Huerfano County near the town of Gardner, Colorado. These concerns were taken into <br />consideration, however, on November 30, 2001, the Division of Minerals and Geology approved <br />the 110 construction materials application for the Orlando Pit. <br />Under the provisions of Rule 1.4.11 of the Construction Materials Rules and Regulations of the <br />Colorado Mined Land Reclamation Board, any person who can demonstrate that he/she is being <br />directly or adversely affected by an action of our Office, including a decision to-deny or approve <br />a permit application, may petition the Board for a hearing on the Office's action within 30 days' <br />of the decision. Such petitions for a hearing shall state how the petitioner is directly affected or <br />aggrieved by the Office's decision, and how the petitioners interests are entitled to protection ` <br />under the Act (C.R.S. 34-32.5). The petitioners shall list and explain any issue the petitioner <br />believes should be considered by the Board ai the hearing on the matter, and. include the specific <br />file number as assigned by the Offce. <br />If you wish to proceed with a petition, you will need to submit such a request in writing by <br />December 30, 2001.
