Taylor <br />382 Denver Club Building <br />518 17th Street <br />Denver, Colorado 80202 ~ // >°/ <br />RE: Fondis Pit (File M-88-101) ~/ l <br />Dear Mr. Taylor: <br />We have received your May 7, 1990 correspondence requesting that the Division <br />cancel the Fondis Pit permit and supervise site reclamation. Our staff will <br />review the permit documents and then inspect this site to determine whether <br />the operation is being conducted in accordance with the approved permit and <br />the Mined Land Reclamation Act. We will inform you of the result of this <br />investigation. Due to significant budget and staff limitations, the site <br />inspection may not occur until July, 1990, which is the beginning of the new <br />fiscal year. <br />The Mined Land Reclamation Board has the authority to modify, suspend or <br />revoke a permit (CRS 34-32-124(6)(a)). However, before any of these actions <br />can be taken, the Board must first find that the operator is in violation of <br />the permit or the Act. The finding that a violation exists is made after the <br />Division has collected appropriate evidence to present to the Board. Evidence <br />presented would be a result of our investigation. If the Board finds that an <br />operator is in violation, corrective actions are ordered. These actions are <br />designed to obtain compliance at the site within a specified time frame. If <br />the corrective actions are not completed within the specified time period, the <br />Board mdy then move to revoke the permit and order site reclamation. <br />Again, we will inform you of the results of our investigation, and notify you <br />if a hearing before the Board will be held.
