A succession of operators and transfer of Permit No. M-80-110 from <br />Henderson Development Company to Colorado Sand and Gravel Company was approved <br />conditioned upon receipt of the Performance Warranty and Financial Warranty in <br />the amount of E79,940.00 for the new amended permit (copies of forms enclosed). <br />2. The amendment application which enlarges the Adams Pit permit area to <br />75.75 acres and absorbs the permit area of the Sandy Acres Pit was approved <br />contingent upon final approval by the Adams County Commissioners (scheduled <br />for December 31, 1985). The total financial warranty for the new expanded <br />permit area was set at E79,940.00. <br />Upon receipt of the Performance and Financial Warranties as described above <br />and written verification of approval of the amendment by the Adams County <br />Commissioner, the succession of operators to your company will become <br />effective, and I will return Henderson Development Company's existing <br />financial warranty. Furthermore, the approved amendment will also then go <br />into effect. Finally, File No. M-81-159 will then be terminated due to its <br />absorption into File No. M-80-110. You and Henderson Development Company will <br />receive notification of all of these actions upon receipt of the warranties <br />and verification of County approval.
