<br />THIS PER,`lIT is- issued this 20 day of December, 1978 by the dined Land
<br />Reclamation Board, Department of Platural Resources, State of Colorado.
<br />41 I T N E S S E T H
<br />4.RIEREAS, Dick Casey Concrete, Inc. desires to conduct a(n) open mining
<br />operation, known as DICK CASEY CONCRETE PIT for the purpose of eztr.acting open
<br />mined sand 6gravel; anal
<br />I.gIERF.AS, on November 29 19 78, Dick Casey Concrete, Inc "FILED" an
<br />application,a reclamation oleo znd map, and the required Eee, as required by law; and
<br />1JHERE:\S, on December 20 19 78, the `final Land Reclamation Board approved
<br />The Dick Casey Concrete Pit application. and set bond; and
<br />WHEREAS, on December 20 19 78, the ;Lined Land Reclamation Board accepted
<br />surety submitted b}~ Dick Casey Concrete, Inc. and srich date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />LJHER~AS, the )lined Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies ~.+ith the requirements of the Colorado
<br />}tined Lard ~:e clamation Act and all applicable local, state and
<br />Fedc-ral laws; and,
<br />2) the operation will not adversely aEEect the stability of any
<br />si;niticant valuable, and permanent man-made s[ructures located
<br />within two i~undred feet of the affected land, e:~:cept ~.ahere there
<br />is an agreement between the operator and the persons havin^ an
<br />i.ntzrest ir. the structure chat damage to Cne structure is to be

<br />3) [he proposed ;wining operations and reclamation car. be Carried out
<br />in conEor:nance with the requirements oC C.F.S. 1973, 34-32-11G, as .
<br />amended (1976 Sess. i.aws H.B. 1060; and
<br />11i1EREA5, for the purposes of issuing this permit, the operator has made a
<br />satisfactory shrn.aing to the Board that he will employ during wad after his
<br />open mining operations procedures reasonabl}' designed to minimize
<br />as much zs practi.cable tl~e disruption from the ope^ mining operations
<br />and will provide Eor the rehabilitation of the affected land through the rehabilitation
<br />of p1anC cover, soil stability, water resources, and other measures approoriate to the
<br />subsequent beneficial use of such mined and reclaimed lands; and that in the event
<br />of the failure of his proposed reclamation plan, he will take whatever measures which
<br />c,av be necessary in order to assure the success of reclamation of the lands affected
<br />by 'n is open mining operations; and,
<br />4!!11~:REAS, Eor the purposes of issuing this permit, a copy of the application
<br />approved by the ?lined Land reclamation Board of the State of Colorado is attached
<br />to this oermit and chereby becomes a part of the terms hereof.
