Our file 1177-546 and 1177-547. <br />Dear Mr. Horvath: <br />The purpose of this letter is to acknowledge receipt of the additional <br />information requested in my letter of December 7, 1977. The new information <br />makes the application complete. From an adequacy standpoint there is <br />considerable information needed in order to make a favorable recommendation <br />to the Mined Land Reclamation Board. Had I not been ill a considerable <br />portion of the past two weeks, I would have been able to give the applications <br />the prompt attention required in order to make them adequate for the <br />February 22 and 23, 1978 Board meeting. With this in mind, I would request <br />that you agree to a continuance to the March 22 and 23, 1978 Board meeting. <br />This would give us ample time to work together in making the applications <br />adequate for Board presentation. In addition, I see that you published <br />according to the Requirement of Rule 3 of the Rules and Regulations. The <br />problem is that the publications appeared before the application was <br />statutorily complete. While I realize that you may not have been aware of <br />the amendment of September 29, 1977 to Rule 1, an application is not <br />considered filed, submitted or received until all items required under the <br />law have been received. I have enclosed a copy of the amendment for your <br />information. After conferring with our representative from the Attorney <br />General's office, it appears that the public notice will have to be published <br />an additional two times.
