May 17, 2005 <br />~~~~~~~~ <br />MAY 2 02005 <br />Mr. James Burnell ~~~M1rera~s aoe ceoloav <br />Environmental Protection Specialist <br />Colorado Division of Minerals & Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Oxbow Mining, LLC -Elk Creek Mine Permit No. G1981-022, <br />Notice of Intent for 2005 Elk Creek Mine Coal Exploration Activities <br />Dear Mr. Burnell: <br />Zoo~_2z~01 <br />Oxbow Mining, LLC (OMLLC) herein requests the approval of the enclosed 2005 Notice of Intent <br />to Explore (IVOI) for completion of drilling activities associated with mine planning, coal resource <br />confirmation and future development of the Elk Creek Mine. <br />The drilling program per this NOI involves completion of up to six (6) exploration holes, with three <br />(3) holes located within the Elk Creek Federal Coal Lease COC 61357 and three (3) holes located <br />within the South West Elk Creek (SWEC) coal exploration license area COC 68482. <br />During 2005 OMLLC also intends to conduct exploration drilling activities under X-2004-223-05, <br />AM-2 approved on May 2, 2005 in accordance with information submitted by OMLLC in April 22, <br />2005. <br />In conjunction with drilling and completion activities, in-hole logging and tests, as well as core <br />samples of the roof, coal seam and floor materials will be collected from the drill holes and analyzed <br />to characterize the geotechnical characteristics and conditions of the mine roof and floor, as well as <br />to detemune coal quality. This NOI application submittal consists of the following components: <br />• This transmittal Letter <br />• Executed NOI Application Form <br />• Attached Description of Affected Lands, Exploration Activities, and Reclamation Cost <br />Factors <br />~P <br />Cultural and paleontological resources, threatened and endangered (T & E) species assessments, and <br />raptor nest site surveys will be surveyed early in the summer of 2005 for the roads and sites included <br />in this NOI.
