This includes stormwater discharges from private
haul roads, processing azeas and equipment storage areas. From the maps that you sent, it appears
that you may be able take advantage of this exemption, but the scale of the USGS quad map is too
small for the to make that determination.
In cases like this, it is our practice to accept the determination made by the operator of the mine,
until the time that an inspection by the Division of Minerals and Geology (DMG) or Water Quality
Control Division indicates otherwise. You are the most familiaz with the borrow site proposal at
this time, and you can best decide whether stormwater will leave your site. Please remember that if
your site layout changes over time and a discharge stormwater from your activity becomes likely,
you may not discharge without a permit.
I have enclosed a copy of the stormwater permit application form for your use if you determine that
runoff leaves the site. [have also sent a copy of this letter to Jim Stevens at DMG.
If you have any further questions, or I can help in any way, please contact me at (303) 692-3609.
Sincerely yours,
Sarah Johnson /
stormwater Unit Leader
Permits and Enforcement Section
WATER QUALITY CONTROL DIVISION
xc: Local Health Department
District Engineer, WQCD
Jim Stevens, DMG
