Long <br />D~sivon Direcccr <br />i On November 21, 1997, the Division conducted an inspection of the proposed Stone <br />Gravel Pit permit area and observed evidence of recent exploration activities. DMG <br />records indicate that exploration activities were conducted prior to submittal of <br />Notice of Intent to Conduct Exploration Operations. <br />We believe this is in violation of Section 34-32.5-113(1) of the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials, 34-32.5-101 et sec ., <br />C.RS. (1995 Repl. vol.), <br />Therefore, we have found reason to believe a violation exists to the Law and have <br />scheduled this matter before the Mined Land Reclamation Boazd. ~ <br />A Formal Public Hearing will be held during the January 28-29, 1998, Board <br />meeting for consideration of possible violation. The hearing will be held at 1313 <br />Sherman Street, Room 318. Denver. Colorado. beginning at 9:00 a.m. or as soon <br />thereafter as the matter can be considered. You will have the opportunity to be <br />represented and heard. It will be reiterated that there is reason to believe that you <br />are in violation of the provisions noted above. <br />i. <br />If the Board finds a violation at the hearing, it may issue a cease and desist order <br />and assess civil penalty of not less than S50.00 per day nor more than $200.00 per <br />day for each day the land has been affected. Such,penalties shall be assessed for not <br />less than one day and not more than sixty days. Concurrently with the issuance of <br />such an order, the Boazd or the Office may Seel: a-restraining order or injunction. <br />In addition to the civil penalty, the Board may assess against the violator, any cost <br />incurred by the Board orOCticein carrying out corrective action. <br />1 <br />P.4i5 <br />of coLor~o <br />
