OPEN PIT <br />FONDIS - No. M-88-101 <br />12/31/88 <br />Dear Sir: <br />Thank you for sending Mr. Hernandez and Mr. Stevens out to Fondis on July 3, <br />1991, to address my complaint. These two gentlemen were very fair, professional <br />and business-like in their inspection. <br />I also visited briefly with Chairman Starkey of the Elbert Co. Commissioners <br />in regard to settlement of my claims against this operation and he said that they <br />would address them at their next meeting. However, since my loss will probably <br />go to arbitration or litigation, would you please send to me the following: <br />1. Form to send to Attorney General's Office stating intent to file suit <br />against Elbert County for loss. <br />2. Copy of letter approving second haul road design - "Twenty-five year <br />life, 24 hr. event" which lasted about 8 months. <br />I also respectfully request that you defer any expansion of this pit until <br />my claims are settled. <br />Regards, <br />James R.
