The Division <br />has two remaining items that need to be addressed prior to appmvat of the application. <br />1. The operator states that the future development area will not receive topsoil prior to revegetation of <br />the area. No topsoil in this area is acceptable if the azea is developed prior to release of the site from <br />reclamation liability. However, if the site is not developed as planned the area must be reclaimed to <br />achieve the standards of Rule 3.1.10. Please commit to a plan to replace topsoil in this area in the <br />event the area is not developed for commercial or industrial use prior to bond release. <br />2. The operator states that Hall Irvin will operate in accordance with the Spill Prevention Control and <br />Countermeasure plan as a means to protect against pollution of surface of groundwater both during <br />and after the mining operation. Please provide the specifics as to how this plan will be implemented <br />on site. <br />Because objections were filed with the Division, this matter must be set for a hearing before the Mined <br />Land Reclamation Board (NLRB). The tentative date for the hearing is July 15-16, 2006. However, the <br />Division will need to make a recommendation by June i2, 2006. Please be advised that Parker/Dersham <br />Resource application may be deemed inadequate, and the application may be recommended for denial on <br />June 12, 2006 unless the above mentioned adequacy review items are addressed to the satisfaction of the <br />Division. If you feel more time is needed to complete your reply, the Division can grant an extension to <br />the decision date. This will be done upon receipt of a written waiver of your right to a decision by <br />June 12, 2006 and request for additional time (including a date for consideration before the NLRB).
