Stover & Associates <br />2768 Compass Dr., Ste 101 Pond D is BRL' s Pond F <br />Grand Junction, CO 81506 <br />RE: Bowie Mine No. 2 Ponds D, J & K Substitute Supply Plan <br />Sections 14 & 15, Township 13 Soufh, Range 91 West, 6th P.M. <br />Case No. 02CW077 <br />Water Division 4, Water District 40 <br />Dear Mr. Stover: <br />We have completed review of your request on behalf of Bowie Resources Limited (Bowie) <br />for renewal of a substitute water supply plan for Ponds J & K, and a new plan for Pond D, all at <br />• the Bowie Mine No. 2. Case No. 02CW077, filed with the Division 4 Water Court on May 31, 2002, <br />includes a plan for augmentation intended to replace evaporative depletions for these ponds, <br />excepting an expansion for Pond D. As such this plan has been reviewed pursuant to CRS 37-92- <br />308(4) 8r (5). A $300.00 fee has been filed for each plan. Since no objections to the court case <br />were filed, the notice provision described in CRS 37-92-308(4)(11) is not applicable. Proof of notice <br />as described in CRS 37-92-308(5)(11) has been submitted. No objections were received. <br />Bowie Mine No. 2 is located on an unnamed tributary of the North Fork Gunnison River, <br />which is downstream of Hubbard Creek and upstream of Terror Creek. Sedimentation Pond D will <br />be, and Ponds J & K have been, constructed on-site to capture runoff, in addition to the three <br />other sedimentation ponds to be augmented per pending Case No. 99CW263. It is assumed that <br />Ponds D, J & K will be operated in the same fashion as the other ponds, such that the normal <br />water surtace will be maintained at the level of the outlet, and immediately following storm events <br />±h? water level will be higher, but only for a short period of time. As such, complete draining of the <br />pond through the outlets is not possible, and dead storage will remain in the ponds. Although the <br />plan for augmentation contemplates replacing evaporation from the ponds during a call period, the <br />need to replace depletions due to a first fill of dead storage and/or refrlling seepage from dead <br />storage during a call period was neglected. <br />The plan proposes to replace evaporation from the sedimentation ponds with East Beckwith <br />No. 1 Reservoir water and a change of water rights decreed in Case No. 3503 for the Deer Trail <br />Ditch. Bowie claims a lease of 25% of the 383 acre-foot storage water right remaining of that <br />originally decreed in Case No. 2563, per abandonments in Case Nos. 89CW121 and 92CW57, <br />which amounts to 95.75 acre-feet. Note that in Case No. W-3106, 74 acre-feet of the water leased <br />from the reservoir was changed to industrial, domestic and irrigation use for an augmentation plan <br />• decreed therein, and that 8.17 acre-feet is required for augmentation per pending Case No. <br />99CW263, therefore, 13.6 acre-feet of the leased storage right remains unchanged and is <br />~2- 3 a <br />APPRovEJj <br />3/23/0 1.J <br />
