At this late date, T <br />am worried that even if Owens does send me something now, i won't have adequate time <br />to review it with my engineer, formulate an adequate response to Owens, and acquaint <br />the DMG stafFwith any concerns I might have in time for those concerns to be taken into <br />consideration in the staff decision. <br />Therefore, T think perhaps T had better outline for you now my main concerns with the <br />November ZOO I version of the wetland mitigation plan. These concerns, which were <br />communicated to Owens in a letter dated January 30W, 2002, arc as follows: <br />1. County Barrow Pits. The main problem with the November 2001 mitigation plan <br />offered by Wright Water Engineers (WWE) on behalf of Owens is that the plan cannot be <br />implemented. The central theme of the whole plan is based around the concept of <br />creating a "wall of water" between my farm and the Owens mining operation by filling <br />the county barrow pits alongside WCR 28 with water from Lake 3A. However, the <br />county has refused to authorize this use oithe barrow pits. Therefore, all aspects of <br />the mitigation plan which depend upon or relate to this wall of water are now invalid. <br />2. as Cha_rrete Ditch Water. WWE has recommended delivering water to the <br />wetland slough from the Last Chance Ditch via the easternmost headgate and lateral that <br />flows into the slough. However, no headgate exists whore WWF shows a headgate on <br />their plan, and the easternmost lateral W WE shows for carrying the water firm thin <br />
