Walther
P.O. Box 93 Executive Director
Pueblo, CO 81002 Ronald W. Cattany
Acting Division Director
RE: GCC Rio Grande, Inc.; Red Rock Plant and Mine, File No. M-2002-004
Mr. Lenihan,
In response to your June 1, 2002 letter to me on the above-referenced matter, you have
requested to be notified regarding future hearings on this permit application, and to have
the opportunity to present evidence in this case before the Mined Land Reclamation
Boazd.
The deadline to file an objection to this application was May 2, 2002. The Division of
Minerals and Geology has no record of a timely objection on your behalf. Therefore, you
do not have the status of a party to this hearing. There will be a brief period during the
hearing in which members of the public may be permitted to speak. If you wish to speak
at that time, you may do so. However, keep in mind that other members of the public
may wish to speak as well, so your comment time may be very limited.
Notice of the hearing in this matter will be published in the local newspaper, as provided
by law. Since you are not a party to this case, you are not entitled to personal notice of
the hearing.
Of course, if a party to this hearing decides to retain you as counsel to represent them in
the hearing, then you will be allowed to participate on behalf of that party. You may also
petition the Board for party status.
Sincerely,
Sandra Brown
