Cattany <br />Acting Division Director <br />RE: GCC Rio Grande, Inc.; Red Rock Plant and Mine, File No. M-2002-004 <br />Mr. Lenihan, <br />In response to your June 1, 2002 letter to me on the above-referenced matter, you have <br />requested to be notified regarding future hearings on this permit application, and to have <br />the opportunity to present evidence in this case before the Mined Land Reclamation <br />Boazd. <br />The deadline to file an objection to this application was May 2, 2002. The Division of <br />Minerals and Geology has no record of a timely objection on your behalf. Therefore, you <br />do not have the status of a party to this hearing. There will be a brief period during the <br />hearing in which members of the public may be permitted to speak. If you wish to speak <br />at that time, you may do so. However, keep in mind that other members of the public <br />may wish to speak as well, so your comment time may be very limited. <br />Notice of the hearing in this matter will be published in the local newspaper, as provided <br />by law. Since you are not a party to this case, you are not entitled to personal notice of <br />the hearing. <br />Of course, if a party to this hearing decides to retain you as counsel to represent them in <br />the hearing, then you will be allowed to participate on behalf of that party.
