Cattany <br /> Division Director <br />RE: HaII-Irwin Corporation, File No. M-2002-120 <br />Bernhardt Resource 112c Permit Application -Third Adequacy Review. <br />Deaz Ms. Ortiz, <br />Listed below are adequacy review comments for the Bernhardt Resource 112(c) Permit Application, File No. M-2002-120. <br />The Division of Minerals and Geology ("Division") is required to make an approval or denial decision no later than Apri] 9, <br />2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible to allow for review of the responses prior to a decision. The Division must receive these responses no later than <br />10:00 AM, Tuesday April 8, 2003: <br />Rule 6.4.7 Exhibit G -Water Information <br />1. Section 3.1.6 (1) of the Construction Material Rules and Regulations requires that disturbances to the prevailing <br />hydrologic balance of the affected land and to the surrounding azea and to the quantity and quality of water in <br />surface and groundwater systems both during and after the mining operation and during reclamation shall be <br />minimized. Information provided by the Applicant regazding mitigation of potential impacts raises questions as to <br />how the mitigation will impact the riparian corridor located on the site and, therefore, how the Preble's Meadow <br />Jumping Mouse habitat will be impacted. Therefore, it is necessary for the Division to receive a letter from the U.S. <br />Fish and Wildlife Service indicating that the mining plan has cleazance through them prior to approval of the permit. <br />Please be advised that the Hall-Irwin Corporation, Bernhardt Resource, 112(c) Permit Application may be deemed <br />inadequate, and the application may be denied on April 9, 2003 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can grant an <br />extension to the decision date. This will be done upon receipt of a written waiver of your right [o a decision by Apri19, 2003 <br />and request for additional time. This must be received no later than the deadline date.
