Listed below are adequacy review comments for the Bernhardt Resource 112(c) Permit Application, File No. M-2002-120.
The Division of Minerals and Geology ("Division") is required to make an approval or denial decision no later than Apri] 9,
2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as
possible to allow for review of the responses prior to a decision. The Division must receive these responses no later than
10:00 AM, Tuesday April 8, 2003:
Rule 6.4.7 Exhibit G -Water Information
1. Section 3.1.6 (1) of the Construction Material Rules and Regulations requires that disturbances to the prevailing
hydrologic balance of the affected land and to the surrounding azea and to the quantity and quality of water in
surface and groundwater systems both during and after the mining operation and during reclamation shall be
minimized. Information provided by the Applicant regazding mitigation of potential impacts raises questions as to
how the mitigation will impact the riparian corridor located on the site and, therefore, how the Preble's Meadow
Jumping Mouse habitat will be impacted. Therefore, it is necessary for the Division to receive a letter from the U.S.
Fish and Wildlife Service indicating that the mining plan has cleazance through them prior to approval of the permit.
Please be advised that the Hall-Irwin Corporation, Bernhardt Resource, 112(c) Permit Application may be deemed
inadequate, and the application may be denied on April 9, 2003 unless the above mentioned adequacy review items are
addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can grant an
extension to the decision date. This will be done upon receipt of a written waiver of your right [o a decision by Apri19, 2003
and request for additional time. This must be received no later than the deadline date. If you have any questions, please do
