Cottony <br />Division Direcror <br />Natural Resource Trustee <br />On May 24, 2004, the Division of Minerals and Geology considered your 110 Construction Materials Reclamation <br />Pernrit Application package for the West Johnson Draw, File No. M-2004-038. Preliminary review of the information <br />received determined that two (2) copies of the following items must be received before the Division can consider your <br />application as being submitted and technical review can begin: <br />F.XiiiiiiT (: _ 5,,,,rrP of i, 9n1 Ri~_t,>_F.otnr lRnlP 63 71~ Provide a description of the basis for legal right <br />of entry to the site and to conduct miniug and reclamation, for the Owners of Record described in <br />Subparagraph I.6.2(1)(e)(i}. This may be a copy of access lease, deed, abstract of title, or a current tax receipt. <br />A signed statement by the Landowner and acknowledged by a Notary Public stating that the Operator/Applicant <br />has legal right to emer and mine is also acceptable. Please submit documents executed by the Bureau of Land <br />Management that gives Rio Blanco Couuty the right to enter the land, to be permitted, to mine and do <br />reclamation. <br />F.XHiRTT T. _ PrrmanPnt MAn_MndP Rtn,ENnrPC (R,d,. (~_Z_721r you must provide information sufficient to <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected <br />land will not be adversely affected. If the Office determines that such information is inadequate to demonstrate <br />that the operation will not adversely affect the stability of any significarEi, valuable or peEtEranent man-made <br />structure, the Applicant shall either: <br />(a) provide a notarized agreement betweerE the applicant and the person(s) having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) where such an agreement can not be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities <br />occurring at the mining operation. <br />The Division cannot accept the statemenrt "No power pole structure will be affected by the mining operations." <br />You must submit either (a) or (b) shown above. <br />F.~jiiiRiT i _ Prnnf of Filingwith CmnE ~Clerk~$nln F a y1~ you must provide an affidavit or receipt <br />indicating the date on which the additional requested application information was placed with the local County <br />Clerk and Recorder, Also, refer to Rule 1.6,2(1)(c). <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Genloeical Survey <br />
