My client's ranch lies on approximately 50,000 <br />acres which include natural grass and timber. The water supply <br />consists of natural springs and creeks, ground water from wells, <br />and supplemented by irrigation canals. The land also contains <br />several residences. <br />It is our understanding that a pre-conference hearing will <br />occur on or about March 27, 2003. This letter will request that <br />my office be apprised of when that date and time have been firmly <br />set and that the pre-conference hearing be conducted in <br />Westcliffe, Colorado. It is our understanding that numerous <br />residents of Custer County and other land owners have a desire to <br />participate in the pre-conference hearing and thereby express <br />their objection to the application. This letter constitutes <br />notice of formal objection of my client to the above mentioned <br />application. My client also wishes to participate in the pre- <br />conference hearing and to present testimony when the application <br />is considered by the Mined Land Reclamation Board. <br />In the Division's January 2, 2003 letter to Joe Gagliano of <br />LJ Development, Inc., you require that the Division be provided <br />with the source of legal right of the applicant to enter and <br />initiate a mining operation on the affected land.
