TCC would like <br />clarification, however, regarding Stipulation #2 which states: "Trans Colorado Concrete will not disturb <br />more than 25 acres until the appropriate warranty is posted and written approval is obtained from <br />DMG." <br />HiSfOrY <br />In Exhibit L of the original application, dated February 19, 2004, we estimated reclamation costs based <br />on 80 acres of initial total disturbance (30 acres mining, 30 acres for the processing area, 20 acres for <br />settling ponds). The Division, in its adequacy response letter dated April 19, 2004, estimated the bond <br />to backfill the entire mine site (210 acres) at over $3 million. Subsequent verbal discussion as to <br />"phasing" the mine plan resulted in our request to limit the pit size to 25 acres. It was the applicant's <br />intent to mean 25 acres of mining (plus plant area and settling ponds). <br />Reouest <br />Trans Co!crado Concrete (TCC) would like the Division to provide copies of the cost estimate that <br />resulted in the current bond amount to determine whether the bond covers reclamation on both mined <br />and non-mined areas. TCC also requests that the Division recalculate the bond, if necessary, to <br />account for the backfill of 25 mined acres above the water table, while also disturbing 30 acres for <br />processing and stockpiling, and 20 acres for settling ponds.
