In that regard, the wetlands are not waters of the U.S. <br />pursuant [o Section 404 of the Clean Water Ac[. <br />This project has been reviewed in accordance wish Section 404 of the Clean Water Ac[ under <br />which the U.S. Amly Corps of Engineers regulates the discharge of dredged and fill material and any <br />excavation associated wish a dredged and fill project in waters of the United Slates. Waters of the <br />U.S. includes ephemeral, intermittent and perennial sVeams and [heir surface connected wetlands <br />and adjacent wetlands and certain lakes and ponds that have a nexus to interstate conunerce.
