Hendricks: <br />The Division's preliminary adeouacv review letter (PAR) for the Carbon <br />Junction nine permit renewal was sent to you on January 10, 1989. On January <br />19, 1989, a document ore sentinq the results of our bondina evaluation was <br />forwarded to you. With the exception of certain hvdrologic monitoring data we <br />received February 15, 1989, the issues raised by our review have not vet been <br />addressed by Pueblo Coal, Inc. The monitoring data submitted was incomplete <br />and your letter indicated that required monitoring had not been performed in <br />1988 tlue to Pueblo Coal Ines inability to pay for the laboratory analyses. <br />NOV C-89-005 was issued tlarch 14, 1989, due to the failure to perform the <br />required hvdrologic monitoring. , <br />A number of issues raised by the PAR and the bondina review must be resolved <br />for the Division to be able to make the findings necessary to recommend <br />approval of the permit renewal. In addition, the inability of Pueblo Cnal, <br />Inc. to pay for reouired hvdrologic analyses calls into question the <br />operator's ability to maintain the site in compliance with the permit and <br />regulations. <br />February 21, 1989 was the 120th day since the renewal application was deemed <br />complete. Due to the nature of the review and the status of the operation, <br />the Division has extended the review an additional 50 days, to April 24, 1989, <br />pursuant to Rule 2.07.4(2)(b). The Division cannot extend the renewal <br />decision time-frame beyond the 180th day unless a waiver is requested by the <br />applicant and granted b.v the Division, with both parties agreeing to a <br />specified time schedule for review completion, If the issues raised during <br />the renewal review are not satisfactorily addressed, or a waiver re guest is <br />not approved prior to April 24, the Division will issue a proposed decision tc <br />deny the renewal application. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
