Mount <br />Division of Minerals and Geology <br />1313 Sherman Street <br />Room 215 <br />Denver, Colorado 80203 <br />Dear Mr. Mount: <br />nl'!'[-I~~Nh' <br />Hur ~ ~ 199E <br />Division of mu~elals a ~~~•~~~~~ <br />Reference is made to the Owens Brothers Concrete Company, Del Camino Sand & <br />Gravel Mine (your File No. M-96-052) located in Section 32, Township 3 North, Range 67 <br />West, Weld County, Colorado. <br />If any work associated with this project requires the excavation in or placement of <br />dredged or fill material, either temporary or permanent, into the Saint Vrain Creek or <br />wetlands at this location, this office should be contacted for proper Department of the Army <br />permits pursuant to Section 404 of the Clean Water Act. <br />Please be advised that the U.S. Fish and Wildlife Service (USFWS) has determined <br />that the Ute ladies' tresses orchid, S~iranthes diluvialis, may occur in seasonally moist soils <br />and wet meadows near springs, lakes, or perennial streams and their associated flood plains <br />below 6,500 feet elevation in certain areas of Colorado. This plant species is now officially <br />listed as threatened under the Endangered Species Act. For projects in specific areas, a <br />survey for this plant species, approved by the USFWS, will be required before the Corps of <br />Engineers can issue authorization for work within waters of the United States.
