This is in reply to your Adequacy Review of December 5, 2000, and [he items will be addressed in the same order as you presented them. NOTICES: The publication of a newspaper notice was no[ submitted with [he permit since we have found out that it is not wise to publish until a complete notice is received from the Division. This has been accomplished and attached is a copy of the newspaper publication of December 7, 2000 as well as the Affidavit of Publication from the Huerfano world. The City of Walsenburg is the only adjacent o~wter to be notified. Attached is proof of mailing and the green Return of Receipt Card. WARRANTIES: Attached is a Performance Warranty executed by Fred A. Rodriguez, Mayor of Walsenburg. Exhibit A :The revised Exhibit "A" map is attached. Exhibit C: (Rule 6.3 (b)) It is probable that the stockpiled topsoil will remain in place for more than one year. If so, the applicant commits to seeding with 7#/A PLS Western Wheatgrass. Exhibit C: (Rule 6.3 (k)) The applicant does not believe that any refuse or acid or toxic producing materials will be exposed. However, if any are found, the applicant commits to have them handled in the required safe manner and removed from the site. Exhibit D: (Rule 6.3.4 (c) (ii) The statement that the fertilizer will be applied at the rate of 4,000#/A is obviously confusing and incorrect.
