Mike Sherman (Field <br />Habitat Biologist) and Mtke Babler (District Wildlife Manager) have reviewed this Reclamation Permit <br />Application Consideration and made a field visit to the site with the applicant/operatnr on Lune 7, 2001. <br />We recommend a 100+ foot setback of the mining operation boundary .from the ditch running along the <br />south and east sides of the proposed project. Although this ditch contains numerous weedy plant species, <br />it does provide for fair wildlife habitat for amphibians, reptiles, and small mammals. <br />We recommend that if any ripazian or wetland habitat (inchtding non-jurisdictional wetlands) will be <br />impacted, then the operator limit disturbance to wetlands and riparian habitat to between September 15 to <br />April 15 to avoid the probable disturbance to bird species that may be using this area d„*+ ~ the critical <br />breeding season <br />We observed an active prairie dog town on the site. Prairie dog removal on this site should be required <br />prior to mining activities beginnbtg. Trapping/transplant efforts or euthanasia aze legal option3 for prairie <br />dog removal Euthanasia efforts must occur through the use of approved toxicants and trapping and <br />transplanting ofpra¢ie dogs requires prior approval of the Colorado Division of Wildlife. I~lote that <br />bulldozing active prairie dog colonies is not an acceptable method of removal. <br />Furthermoto, since prairie dogs are presetrt at this site then surveys ere needed for baM eagle, terrugmous <br />hawk, and western bturowutg owls. All bird species are protected by the law and killing one is illegal. The <br />bold eagle (Federally and State Threatened) and femrgmous hawk (State Special Concern) u~ prairie dog <br />towers for feeding and the western burrowing owl (State Threatened) live in pra¢ic dog holes. The fallowing <br />should be observed: <br />- If construction is to occur between March 1 and October 31, the azea should be checked for the <br />presence of burrowing owls prior to arty earth-moving tal~tg Place.
