Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are remaining adequacy review comments on the above-captioned Regular 112 Application <br />for 526.70 permitted acres. The recommended decision date for your application is currently scheduled for <br />September 16, 2005. Two (2) copies of your adequacy response must be submitted and received by the <br />Division by no later than 5:00 P.M. on September 14, 2005 to allow Division staff sufficient review time. <br />If the Applicant requires additional time to adequately respond to the concerns presented in this letter, the <br />Applicant may request an extension of the recommended decision date. Such a request must be made in <br />writing and must be received on or before September 16, 2005. Please be advised that you will need to <br />provide all information or commitments requested below and/or resolve all remaining concerns of the <br />Division on or before the September 16, 2005 recommendation date. Failure to do so will result in a <br />Division recommendation of denial of your application. If you elect to request an extension the of <br />recommended decision date, the Division will also need to revise the Pre-Hearing Conference date and <br />Mine Land Reclamation Board Hearing date. <br />6.4.4 EXHIBIT D - Minin¢ Plan <br />Drainage Designs <br />10-17. Hydraulics- 5.1 Diversion Ditches, 5.2 Sediment Ponds, 5.3 Culvert Capacity <br />A. The Division suggests that the Applicant commit to conducting an annual maintenance survey of the <br />sediment ponds, drainage channels, spillways, culverts, and other hydraulic structures on site; and perform <br />maintenance as necessary. (An example would be cleaning out the culverts, drainage channels, and <br />sediment ponds prior to the upcoming spring runoff each year). Please respond. <br />B. The Division requests that the Applicant commit to evaluating the need for a filter fabric or liner <br />beneath any riprap installation, and install such filter fabric or liner if needed. Please respond. <br />C. The Division requests that the Applicant commit to providing an "As-Built Certification" from a <br />registered professional engineer for all hydraulic structures installed at the MMRR Quarry, including <br />Office of Office of Colorado <br />Mined land Reclamation Active and Inactive Mines Geological Survey <br />
