Dept. of f~;tural ~,csotlrca~ <br />Reference is made to the letter dated 12 April 1982 from Mr. Lavern C. Nelson <br />of Nelson Engineers informing this office of the proposed subject project <br />near St. Vrain Creek. <br />The Corp's jurisdiction over the proposed activity stems from Section 404 <br />of the Clean Water Act. Section 404 requires a Department of the Army permit <br />for the discharge of dredged or fill material placed below the ordinary high <br />waterline in our Nation's lakes, waterways and wetlands. <br />Based on the information submitted the project will not involve the place- <br />ment of fill material below the ordinary high waterline of St. Vrain Creek <br />or any wetland area. Accordingly, a Department of the Army permit will not <br />be required. <br />However, it is recommended that a berm of at least 100 feet high be con- <br />structed and maintained between the gravel pit and St. Vrain Creek. St}ould <br />riprap or fill material be placed below the ordinary high waterline to accom- <br />plish this, a Department of the Army permit will then be required. <br />This determination does not obviate the requirements to obtain state or <br />local assent as required by law. <br />If you have any questions contact this office or telephone Mr. Rick Osborn <br />at (402) 221-3056. <br />Sincerely, <br />~,~ / RALPH J.
