FOR A MINED LAND RECLAMATION PERMIT <br />BEFORE THE COLORADO MINED LAND RECLAMATION BOARD PUR- <br />SUANT TO THE MINED LAND RECLAMATION ACT OF 1976 <br />P F.TITTON <br />We, the undersigned, as landowners in the immediate vicinity of <br />the mining operation contemplated by A. F. Sons, Inc. or Hazeltine <br />Investment Co. petition this body politic to withhold its approval <br />of any action taken on behalf of the mining operation and state their <br />reasons therefor as follows: <br />1. The mining operations will cause all the shallow <br />water wells in the immediate area to go dry. The water <br />from these wells are an absolute necessity to adjacent and <br />immediate propecty owners. <br /> 2. Hazeltine, Inc. does not have sufficient water to <br /> y satisfy replacement requirements imposed by Colorado Water <br />Q o ~ Resources Board; moreover, even if additional shares of <br /> Q N Fulton Ditch water become available the present access to the <br /> ~ g m property will not carry additional water and Petitioners Scott <br /> rn ~ ~ Utz and Judith Utz will not consent to any enlargement of said <br />W o ~ ~ facility over their land. <br /> ~ °Z <br />V a z ~ 3. The mining of sand and gravel will create an inordinate <br /> N J n amount of dust particles in the air which will constitute a heatlh <br />W p c <br />w hazard and a nuisance to the surrounding area. <br /> ~ U 4. The .noise from the mining machinery and trucks used to <br /> haul the sand and gravel will constitute a nuisance to the <br /> adjacent landowners and a hazard to other traffic in the area. <br />5. Any bond necessary for reclamation purposes should be <br />in excess of $500,000.00. A bond in the amount of $100,000.00 <br />would not be sufficient to reclaim the area should the operators <br />fail to do so. <br />6.
