<br />THIS PER.'lIT is Issued [his 22 day of November, 1978 by the Mined Land
<br />Reclamation Board, Department of Natural Resources, state of Colorado.

<br />y~HEREas, Mesa County Road Dept desires to conduct ' a{n) open miai.a
<br />g •
<br />operation, known as Webb Pit .. , for the purpose of ext;acting open
<br />mined sand 6 Grsve l, and
<br />WHEREAS, on October ll ,' 1978 , Mesa County Road Dept. "FILED"•ah appli-
<br />cation, a reclamation plan and map, and the required fee, as required by law; and •'
<br />WHEREAS, on November 22 , 1978 , the Mined Land Reclamation Board approved
<br />•the.Mesa County Road Dept' application and set bond; and
<br />WHEREAS, on November 22 1978 the Mined Land Reclamation Bo aid accepted surety
<br />submitted by Mesa County Road Dept. and such date shall be considered the
<br />dace of issuance of the permit and the anniversary date for all other purposes; and
<br />WHEREAS, the Mined Land Reclamation Hoard has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />dined Land Reclamation Act and all applicable local, state and
<br />Federal laws; and, •
<br />2) the•oper•ation will not adversely affect the stability of~any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except where there •
<br />is an agreement ber~een the operator and the persons having ar.'
<br />interest in the structure chat damage to the structure 1s to be •
<br />compensated for by the operator; sad,
<br />•3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1913, 34=32-116,
<br />as amended (1976 Sess. Laws H.B. 1065); and

<br />ivHEREAS, for the purposes of issuing this permit, tha operator has made
<br />a satisfactory sh wing to the Board that he will employ during and after his
<br />open mining operations procedures reasonably designed to minimize as muc!
<br />as practicable the aisruption from the open mining operaclons and w'_::
<br />provide Ear the rehabilitation of the affected land through the rehabilitaticn of plant
<br />cover, sail stab illty, water.resources, and ocher measures appropriate to the
<br />subsequent. beneficial use of such mined and reclaimed lands; and t4 at in
<br />the even[ of the failure of his proposed reclamation plan, he will take whatever
<br />measures which may be necessary in order to assure the success of reclamation of..
<br />the lands affected by.his open mining operaclons; sad,
<br />.WHEREAS, for the purposes of issuing this permit, a copy of Che application
<br />approved by the !lined Land Reclamation Hoard of the State of Colorado is attached
<br />to this'permit and [hereby becomes apart of cha Germs hereof.
<br />NOW, THEZ'_'FORE, pursuant to toe authority set forth in the Colorado :lined
<br />Lard Reclamation act, article 32 of Title 34, C.R.S. 1973, as amAnded•,~(1976
<br />.Sess. Laws H.d. 1065).che "lined Land Reclamation Board of the State of Colorado
<br />hereby issues a life of the mine permit to Mesa County Road Dept. to engage 1a
<br />open mining for.th~e purpose of extracting open..,
<br />mined ..sand 6'Gravel „n the follwing parcel of ground, to wit: •
<br />An 8.57 Acre tract contained in a portion of the W~ and the SF}Z and the S~NE3L,
<br />all of Section 15,,and that part of the FSf of Section 16 north of Plateau
<br />Creek, all in township 10 South, Range 9fi Weat of the 6th pM, Mesa County,
