Permit No. 74 - 70 <br /> LAND RECLAI;ATION BOARD % III III'll'IIIIIIIII <br /> Department of Natural Resources sss <br /> Room 114, 1845 Sherman Street Telephone: 892-3403 <br /> Denver, Colorado 80203 <br /> OPEN MINING PERMIT <br /> THIS PERMIT is issued this 17th day of I-lay , 19Z <br /> by the Land Reclamation Board, Department of Natural Resources, State of Colorado. <br /> W I T N E S S E T H <br /> IMREAS, FLATIRON PAVING COMFiUY OF BOULDER <br /> desires to operate an open mine, known as NELSON PIT , for the purpose of <br /> extracting sand and gravel ; and, <br /> ITHEREAS, the Land Reclamation Board has received an application and <br /> reclamation plan and map, a fee and a bond or security for such operation as <br /> required by law: and, <br /> WHEREAS, the Land Reclamation Board has made a finding, for the purposes <br /> of issuing this permit, that the method of operation, physical appearance, and <br /> timetable are reasonable in view of the public interest in physically attractive <br /> surroundings and completion of the operation as soon as practicable; and, <br /> WHEREAS, for the purposes of issuing this permit, the operator has made <br /> a satisfactory showing to the Board that his operation will not adversely affect <br /> the stability of any man-made structure on the area of the affected land and <br /> within two hundred feet of all boundaries of such area; and, <br /> WHEREAS, for the purposes of issuing this permit, the operator has made <br /> a satisfactory showing to the Board that he will employ during and after his open <br /> mining operations procedures reasonably designed to minimize as much as practicable <br /> the disruption from the open mining operations and will provide for the rehabilita- <br /> tion of any such surface resources adversely affected by such open mining operations <br /> through the rehabilitation of plant cover, soil stability, water resources, and other <br /> measures appropriate to the subsequential beneficial use of such mined and reclaimed <br /> lands; and that in the event of the failure of his proposed reclamation plan, he <br /> will take whatever measures which may be necessary in order to assure the success <br /> of reclamation of the lands affected by his open mining operations; and, <br /> WHEREAS, for the purposes of issuing this permit, a copy of the applica- <br /> tion approved by the Land Reclamation Board of the State of Colorado is attached <br /> to this permit and thereby becomes a part of the terms hereof. <br /> NOW THEREFORE, Pursuant to the authority set forth in the Colorado Open <br /> Mining Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, the <br /> Y <br /> Land Reclamation Board of the State of Colorado hereby issues a permit to <br /> Flatiron Paving Company of Boulder to engage in open mining for the purpose <br /> of extracting sand and gravel on the following parcel of ground: po rtsnns of <br /> Sections 19, 29 and 30, Township 2 North, Range 68 West, Weld County. Known as <br /> the Nelson Pit. <br /> This permit is issued subject to all requirements of the Colorado Open Alining Land <br /> Reclamation Act and all rules, regulations and standards now in force and any which <br /> may in the future be promulgated by the Land Recl mat' Board, and is permit may <br /> be revoked or suspended for non-compliance wi rul sh es, regul ons and standards. <br /> ;j <br /> Chaff man, Land Reclamation Board <br /> This permit is valid until June 30, 1980 <br />
