Oehler: <br />I have received your inspection report dated 06-25-98, and I certainly do not agree <br />with your findings. First of all the Sand Arroya Pit to the best of m}• knowledge has <br />been in operation since 1938. V1~'e leased said pit from then owner Frank Maldonado <br />in 1965 and since that time have not changed our mining operations/ <br />Floods wash sand when ever there is a heavy rain storm and the dry river changes <br />each time, that's the reason we cannot mark boundaries and feel after thirty three <br />years have always been and still are in compliance. <br />In regards to the road, (second entrance V1'est) Mr. 'Maldonado always used this road <br />for tree diggers. After purchasing this property from ~~ir. Maldanado we decided to <br />uiilize this road for safety purposes because of a blind curve at the entrance of the <br />original road on Highway 160. <br />The wash plant and concrete area has always been in the same place, it has never in <br />my opinion been a part of the permitted area.
