Preliminary review of the information <br />received determined that the following items must be received before the Division can consider your <br />application as being submitted and technical review can begin: <br />I) EXHIBIT O -Proof of Nlailine of Notices to County Commissioners and Soil Conservation <br />District (Rule 6.4.17): Please submit proof of actual delivery or proof of mailing by Certified Mail, <br />return receipt requested, of Notice of the Application to the local Board of County Commissioners <br />and, if the mining operation is within the boundaries of a Soil Conservation District, to the Board <br />of Supervisors of the Soil Conservation District. <br />Apparently the notice was mailed to the Soil Conservation Service which is a federal agency. The <br />correct address is: South Pueblo Soil Conservation District, Board of Supervisors, % Douglas <br />G. Thacker, 1626 Highway 50 West, Pueblo CO 51008. Please see the enclosed memo <br />regarding this issue. /n order to satisfy our notice requirements, it is important to notify the <br />appropriate SCD office and Board of Commissioners. These agencies are not the same, nor are they <br />interchangeable for our notice requirements. Please verify that the correct agency receive notice. <br />2) EXHIBIT S -Permanent Man-Made Structures (Rule 6.4.19): You must provide information <br />sufficient to demonstrate that the stability of any structures located within two hundred (200) feet <br />of the operation or affected land will not be adversely affected. <br />The E.cltibit appears to be a response to an Envirat:ntental Protection Ptctn requirement rather than <br />an accounting of any man-made structures. Because this is a Construction Materials application <br />nttd not a Hard Rocl/Metal Mining application, the e_rltibit, as presented, is inappropriate. Please <br />sttbntit a corrected exhibit. <br />
