Permit Application, Wittenberg Lakes,112c Application <br />No. M-2004-~1, Additional Adequacy Review Comments/Clarifications <br />Deaz Mr. Schenderlein: <br />The Division of Minerals and Geology (DMG) has received your October 19, 2004 responses to the <br />DMG's October 1, 2004 adequacy review of the Wittenberg Lakes 112 Reclamation Permit <br />application. and would like to have a few items addressed in more detail,. The Division is required to <br />make a recommendation to the Mined Land Reclamation Boazd (MLRB) no later than October 27, <br />2004, therefore, your response to the following items should be received by the Division by noon on <br />October 25, 2004, in order to give the Division some time to review the responses. <br />The Division's questions all relate to 3. Exhibit G- Water Information <br />The applicant's October 19, 2004 response states that " If, during dewatering, or after installation of <br />the slurry wall, the relative groundwater elevation between two or more of the wells differs from the <br />seasonal baseline conditions by more than two (2) feet, the Division will be notified. The Division <br />would like a clarification of the wording, if any one well differs from the seasonal baseline conditions <br />by more than two (2) feet the Division should be notified. Also please describe how the "seasonal <br />baseline condition" will be measured to determine if the two foot difference has occurred . Finally, <br />although the applicant states that the Division will be notified, no notification time frame is proposed. <br />The Division requests that they be notified within five (5) working days of the time that the two foot <br />difference is observed. <br />Pleased be advised that the Aggregate Industries-WCR, Inc. 112c Application maybe deemed <br />inadequate, and the application may be recommended for denial on October 27, 2004 unless the above <br />mentioned adequacy review items are addressed to the satisfaction of the Division. If you feel that <br />more time is needed to complete your reply, the Division can grant an extension to the decision date. <br />This would be done upon receipt of a written waiver of your right to a recommendation to the Boazd <br />by the October 27, 2004 deadline, and a request for additional time.
