<br />THIS PERMIT is issued this 22nd day of May, 1980 by the Mined Land
<br />Reclamation Board, Department of `!atonal Resources, State of Colorado.
<br />W I T N E S S E T H w
<br />WEiERE~1S, La Poudre Sand and Gravel, Inc. desires to conduc{; a(n) open pit mining
<br />operation, known as La Poudre Sand and Gravel for the purpose of extracting
<br />wined sand and gravel.
<br />!dtiERE~S, on December 18 19 79, La Poudre Sand and Gravel, Inc. "FILED" an
<br />application,a reclamation plan and map, and the required fee, as required by law; wad
<br />[1P,EREAS, on April 23 19 80, the Ctined Land Reclamation Board approved
<br />La Poudre Sand and Gravel, Inc. application and set bond; and
<br />WHERE.~S, on May 22 19 80 , the :•tined Land Reclamation Board accept_d
<br />surety submitted by La Poudre Sand and Gravel, Inc. and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all ocher purposes; and
<br />w'HEREAS, the lined Land Reclamation Board has made a finding, fob the purposes
<br />of issuing this permit, that:
<br />1) the application cempLies with the requirements of the Colorado
<br />`tined Land Reclamation ~1ct and all applicable local, state and
<br />Federal laws; and, ,
<br />2) the operation will not =-dversel;~ affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two 1-undred feet of the affected land, except where there
<br />is an agreement between the operator and the persons having an ,
<br />interest in the structure that damage to the structure is ce be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation. can be carried out
<br />in conformance with the requirements of C.R.S. L9i3, 34-32-115, as
<br />amended (1976 Sess. Laws H.B. 1065); and

<br />satisfacttry showing to the Board that he will employ during and aft=r his
<br />open pit mining operations procedures reasonably desig-ed .o -iin_mize
<br />as much as practicable the disruption Erom the open pit minir.3 operaticr.s
<br />and will provide for the rehabilitation of the affected land thro•~g': the rehabiiit_cion
<br />of plant cover, soil stability, canter resources, and other measures annropriace to tr. =_
<br />subsequent beneficial use of such mined and reclaimed lands; ar.d that in the event
<br />of ttie•failure of his proposed reclamation plan, he will take whatever measures a`ni~:i
