Prime Meridian. <br />Dear Sir or Madam: <br />The Niwot Ditch Company has received a referral on the above noted mining application. <br />Our ditch is located on this property, and it is our understanding that pits will be placed <br />on either side of our ditch. <br />Please note that we have historic easements for the ditch, and the historic right to enter <br />the property to maintain, inspect, and operate the Niwot Ditch. No mine should be <br />constructed that encroaches on our easements. No limits can be placed on our right to <br />access the property for purposes of operations and maintenance of the ditch. Since our <br />headgate is located on this property, our employees enter this area on a regular basis <br />during the irrigation season. <br />Arrangements must be made with the Niwot Ditch Company to provide unencumbered <br />access to this azea during and after mining operations.
