Lemm <br />Governor <br />LIMITED IMPACT OPERATION (110) <br />APPLICATION PACKAGE <br />Applicability <br />This package applies to a mining operation which affects less than 10 acres <br />and extracts less than 70,000 tons of mineral and/or overburden per calendar <br />year. If you pin to conduct a mining operation which satisfies these <br />criteria, then you should follow the instructions provided in this package for <br />filing an application. <br />Filing Requirements <br />You should obtain the t4ineral Rules and Regulations from the Division <br />(52.00/copy) and read Rules 3 and 6. To apply for a Mining and Reclamation <br />Permit for a limited impact operation, two copies of the "Limited Impact <br />Operation (110) Application Form" and Exhibits A-G and an application fee must <br />be submitted to the Division. This package contains the application form and <br />instructions for preparing information for attachment as Exhibits A-G. <br />Application P.eview Procedures <br />Upon receipt of the application form, exhibits and application fee, the <br />Division will review them and notify you within 10 days whether they contain <br />the minimum information required by the Mined Land Reclamation Act and Rule <br />of the Funeral Rules and Regulations. If the application contains this <br />information, then it will be considered "complete", and you will be notified <br />to proceed with the notification requirements of Rule 3. If the application <br />does not contain the minimum information, then you will be notified of the <br />information required to make it "complete". <br />Your application will be scheduled for consideration by the Mined Land <br />Reclamation Board within 30 days after it is deemed "complete". You will be <br />notified of the date when the Board will consider your application. The Board <br />will decide whether all of the applicable information and notice requirements <br />of the Act and Regulations have been satisfied and whether the criteria in <br />Sections 115 and 120 of the Act apply. You wile notified of the Board's <br />decision concerning the application. <br />Please note, additional information may need to he added to the application <br />after a "complete" determination in order to satisfy the applicable <br />requirements of the Mined Land Reclamation Act and the i4ineral Rules and <br />Regulations.
