RE: REQUEST FOR DETERMINATION -Exemption of Extraction Activity
from Mine and Reclamation Board Permit Requirements
Dear Sir or Madam:
I have reviewed the information you supplied to the Division, and it is the Division's
opinion that the activity you described will not need a Mined Land Reclamation Board
permit.
The Division's opinion is based on your assertion that no compensation will be received
for the extracted material and that all the material to be extracted and subsequently used
will be extracted and used by the same company. In addition, you have stated in your
submittal that the purpose of the material extraction is to construct a holding pond for
your sanitation processing facility.
Please be aware that the Division's determination that a permit is not needed is simply
the Division's opinion and can be challenged by any party at a hearing before the Mined
Land Reclamation Board.
If you wish to be granted a determination by the Board, you should request that a
Declaratory Order hearing be held before the Mined Land Reclamation Board.
