MESSAGE TO RECIPIENT:
I put together the memo included with this FAX to document the
discussions from last week about legal right to enter an easement and also
to eliminate any potential for confusion between the Division and the
Applicant about what is expected. The pre-hearing conference on this
matter is scheduled for Monday August 7 at 2:00 p.m. in Room 318. Tom
Roan will be present to represent the Board and to act as pre-hearing
conference officer. I have not involved either of you in the scheduling for the
pre-hearing conference because it did not appear that staff consultation with
AGO was needed for this application. Since we have now consulted on this
legal right to enter issue, I will leave it to you to decide if your presence is
needed at the pre-hearing conference. I don't think you need to attend,
particularly since legal right to enter is not an issue that was raised by the
objectors.
