Canany <br />Division Director <br />Natural Resource Trustee <br />Listed below are the fifth adequacy review comments for the Heit Sand and Gravel 112(c) Permit Application, File No. M- <br />2003-016. The Division of Minerals and Geology ("Division") is required to make a recommendation no later than August 8, <br />2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />Pertaining to the potential for changes to the mitigation plan, please acknowledge that these changes tray require a <br />subttrittal to the DMG in the form of a Technical Revision or Amendment to the permit. <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />2. The Applicant indicates that backfilling and grading of the highwall with previously stripped overburden will be <br />concurrent with mining. For purposes of the bond calculation performed by the Division, please indicate the maximum <br />length of highwall that will not be backfilled during mining activities at any one time. <br />Because objections were filed, this matter must be set for a hearing before the Mined Land Reclamation Boazd. The tentative <br />date for the hearing is August 20, 2003. However, the Division will need to make a recommendation by August 8, 2003. <br />Please be advised that the SW Meadow LLC, Heit Sand and Gravel, 112(c) Permit Application may be deemed inadequate, <br />and the application may be denied on August 8, 2003 unless the above mentioned adequacy review items aze addressed to the <br />satisfaction of the Division in a timely manner allowing for adequate time to review the responses. If you feel more time is <br />needed to complete your reply, the Division can grant an extension to the recommendation date. This will be done upon <br />receipt of a written waiver of your right to a recommendation by August 8, 2003 and request for additional time.
