Exhibit C: Please find the signed pre-mining maps and mining plan maps. <br />2. Exhibit D: Please find a copy of the April 17, 2003 correspondence to Don West of the <br />State Engineers Office in which the applicant agreed to release any ponded storm <br />water within 72 hours. Water will not be retained on the site for more than 72 hours. <br />3. Exhibit E: <br />• In the event of a highwall upon termination of mining, the applicant will <br />backfill and/or grade the highwall to a 3:1 slope or gentler. This is not <br />anticipated except along the west side of Phases 3 and 6. The applicant's <br />geologist believes the deposit will not penetrate below the toe of the ridge, <br />therefore, the result will be relatively level grazing land or simply reduced <br />elevation of ridge rather than a depression requiring slope management. <br />Highwalls that occur during the normal course of mining will be managed <br />according to MSHA requirements, either reduced to 3:1 slope or a temporary <br />berm will be constructed at the toe of the highwall to prevent operating close <br />to the face. <br />• As stated in the application, all impoundment structures deemed necessary by <br />CDPHE Water Quality Control Division wilt be removed upon termination of <br />mining. AD water diversion structures will be temporary. <br />= The Fremont County Weed Board provided a list of six noxious weeds of <br />concern and current treatment methods near the proposed site. Please refer <br />to the explanation and map indicating species and treatment currently being <br />implemented to manage the noxious weeds. The applicant agrees to inspect <br />the area following reclamation for the targeted weed species and cooperate <br />with the Fremont County Weed Board in the event the species appear. <br />• Roy Roper of the Fremont Soil Conservation Office did not list fertilizer or <br />mulch in the reclamation recommendation. Mr. Roper was contacted by phone <br />on May 30, 2003. He reiterated his position that fertilizers in the area of the <br />proposed site historically promote weed growth more than the desired grasses <br />and the wind will carry away the mulch, causing blowing debris issues on <br />adjacent property. The applicant intends to broadcast the seed mix as <br />recommended by Mr. Roper. On June 16, 2003, Mr. Roper provided mulching <br />
