Leng <br />Division Direunr <br />I have received a faeed letter from you consisting of the fifth request for an extension for the above-named application. August <br />1, 1999 was to be the decision date for this application, a date by which all required materials were to have been submitted, <br />reviewed and found to be satisfactory and adequate for ilte requirements of this permit. I did receive a packet of materials <br />submitted by you toward completing iltis requirement, but there is no[ sufficient time for their review. Your latest request asks <br />for an extension of the decision date until September 1, 1999. 1 am approving this request, and the decision date is now set for <br />9/1/99. <br />As you are aware, if the requirements aze not met by the decision date, the application ma}' be denied. Therefore, please ensure <br />[hat all responses to the Division's 11/18/98 adequacy review letter and onsite inspection report of 1/13/99 are submitted with <br />enough time for them to be reviewed, and if necessar}' request further clarification from you. If the new date cannot be met, <br />you may consider requesting another extension. <br />Please be aware that, pursuant to Rule L4.2(3), if at the end of 365 days after We submittal date of the apphcation, there are <br />still outstanding adequacy issues to be addressed, ilte decision on the application will be made by ilte Mined Land Reclamation <br />Board during a hearing to be scheduled. That 365-day period ends on 1 I/3/99. <br />As you requested in your letter, I have called and left a voice mail message approving this extension request. <br />Since [Iris application is still in its active review stage, please continue to ensure that all nla[erials pertinent to the application, <br />including your requests for extension and my responses, are being placed far public review at the county clerk and recorder's. <br />Please also ensure that such additional filings are made in a timely manner. By the time of ilte Division's decisioq you will <br />have to have provided proof of each and all such additional filings. <br />Please contact me if you have any questions.
