Gravel Pit Applica4ion~ Apt- a,~o ~-®~.~ <br />Dear Mr. Means: <br />This letter is to inform you that according to City of Delta Zoning Regulations, quarries and gravel operations as <br />well as mineral extraction and processing are only allowed in the I-2 and I-R zoning districts and then only as a <br />Conditional Use which must be approved by the Planning Commission through a public hearing. <br />The Dirt Merchant, Inc. property on which the Wells Pit is located is in an A-1 zone which does not allow far the <br />1 proposed use. The property is located west of 1800 Road, south of 1800 Drive and north of the Roubideau <br />Subdivision. The property has been used for gravel operations prior to its being annexed into the City of Delta. <br />The mining operations are considered a legally nonconforming use at this time subject to the following criteria: <br />1. The use was lawrully existing and maintained at the time the property was annexed into the City <br />2. The use has not and will not be abandoned or discontinued for a period of six (6) months <br />3. The use may be continued only substantially as it existed at the time it became lawfully nonconforming <br />4. The extent or area of the premises utilized may not be materially extended or enlarged. <br />The City of Delta understands that the proposed permit area of 8.5 acres located in the south-west corner of the <br />property includes only the established mining area at the time of annexation. The City further wants to clarify <br />the following in allowing the nonconforming use to continue: <br />1. The mining area will not be expanded beyond the proposed 8.5 acres <br />2. The mining will continue as it has in the past i.e.: <br />a) No crushing equipment will be used at the site, only screening of material may be done on site <br />b) No leasing of the mining operations to another company <br />c) No other consUuction uses such as cement or asphalt plants will be operated on the site <br />If all of the above criteria are met, the City of Delta will not oppose the permit for Dirt Merchant, Inc.
