Mount pQR 2g 1999 <br />Div[tsion of Minerals and Geology DivtsopofMt~ta~&Geow9Y <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Logan Couuty, Bob Terrill Clay Pit, File No. M-99-029 <br />Corps File No. 199980266 <br />Dear Mr. Mount: <br />Reference is made to the above-mentioned project located in the SE '/a of Section 6, <br />Township 7 North, Range 51 West, Logan County, Colorado. <br />The project has been reviewed in accordance with Section 404 of the Clean Water Act <br />under which the U.S. Army Corps of Engineers regulates the discharge of dredged and fill <br />material, and any excavation activity associated with a dredge and fill project, in waters of the <br />United States which may include streams, open water lakes, ponds or wetlands. Based on the plans <br />presented, this project will not require a Department of the Army (DA) permit. <br />Although a DA Permit will not be required for the project, this does not eliminate the <br />requirement that other applicable federal, state, tribal, and local permits be obtained if needed. <br />If there are any questions concerning this matter, please call Mr. Terry McKee of [his <br />office at 303-979-4120 and reference Corps File No. 199980266. <br />Sincerely, <br />c <br />Timo y T.
