Long <br />Division Director <br />RE: Adequacy Review, Western Slope Flagstone Quarry No. 2, Permit No. M-96-076. <br />Dear Mr. Fontanari: <br />Thank you for the 30 day extension to DMG decision date. DMG decision date has been <br />extended from 1 /9/97 to 2/8/97. <br />DMG is reviewing the application for the Western Slope Flagstone Quarry No. 2. The <br />professional quality of the application is appreciated by DMG staff. Unfortunately, the <br />application for permit M-96-076 is not adequate for DMG approval as originally <br />submitted. Please respond to the adequacy issues identified in this letter prior to DMG <br />decision date. If additional time is required to respond, please submit a request for <br />extension to DMG decision date. <br />All Rules and Regulations referenced within this adequacy letter are taken from the <br />Construction Material Rules and Regulations of the Colorado Mined Land Reclamation <br />Board, effective 1/96. If the operator does not possess current copy of the Rules and <br />Regulations, one may be requested from DMG for 58.00. <br />ADEQUACY ISSUES <br />Public Notice -Please provide verification that notice, required by Rule 1.6.2(1)(el, has <br />been received by owners of record of surface and mineral rights to the affected land, and <br />surface owners within 200' of the boundary of the affected lands. Rule 1.6.211)19) <br />states that the application cannot be approved until such verification is received. <br />Exhibit C -Mining Plan -Mine plan states that the pre-existing haul road will be improved <br />on an "as-needed basis". Rule 6.3.3(g- requires that the applicant describe any <br />improvements necessary on existing roads. If substantial upgrades are necessary to <br />support the mining operation, Rule 1.113) requires that the road be included within the <br />permit boundary. Pursuant to Rule 6.3.3(91, please describe all improvements planned for <br />the existing haul road. <br />
