Long <br />Division Dvedor <br />The Division has received your letter of July 12th submitting proof of <br />publication and proof of notifitation to property owners (66 of the 68 for <br />which you have received the certified receipt). The Division also <br />acknowledges previous receipt of the certified mailing to the County Board of <br />Commissioners, the Soil Conservation District, and the County Clerk and <br />Recorder. <br />Enclosed you will find a copy of correspondence from the Army Corps of <br />Engineers, Tri-Lakes Project Office. The map shows the approximate location <br />of wetlands over this permit, areas of which, when compared to the Exhibit C <br />Pre-Mining Conditions, Extraction Plan, overlap or converge. Please comment. <br />The Division of Minerals and Geology can approve and issue a permit with the <br />stipulation that the operator must obtain an approved permit from the <br />Army Corps of Engineers before filling of wetlands can occur. <br />Rule 1.5.1 states that all changes and additions to the permit application <br />(reconsideration) must be filed with the Division and with the County Clerk <br />and Recorder. Please provide proof to the Division with an affidavit or <br />receipt demonstrating that the change was filed with the County Clerk and <br />Recorder not cater than the close of business on the day the change was filed <br />with the Division. <br />Please contact me if you have any questions.
