The permitted map is worthless. I first confronted <br />this problem when I attempted to inspect this site in 1981. It was virtually <br />unenforceable. In order to strengthen the Division's position the permit <br />would need to be made more current and workable. Please note my <br />recommendations in my 1981 report. Due to hospitalization, Mr. Webber was <br />unable to comply. <br />In 1982, I reinspected the site with Mr. Webber, explained my 1981 report and <br />reiterated it in my 1982 report. Both reports are self explanitory. When the <br />engineers/suveyors Mr. Webber hired followed up with a survey, I was up to my <br />neck in inspections so I turned the file over to Zalkind to find someone to <br />handle it. As you can tell from the consultants letter it would have take <br />some time on our part to handle this concern. <br />All in all, little has changed. The operator needs to show the permit area on <br />the maps, update the existing disturbance, and justify why the site is a 110. <br />Bond may need to be adjusted to $5,000.00, and the operator may have exceeded <br />10 acres of disturbance, and may be in violation of mining out side the permit <br />area. <br />The map should be updated and a follow-up inspection made by the staff. Due <br />to the past handling of this file, enforcement action should probably be <br />deferred unless it is the only way to complete the work.
