Due to <br />a right of access issue under litigation, that application was formally withdrawn on February 14th, <br />2005. The application for the Gray Pit #2 Sand and Gravel Mine was re-filed with the Division of <br />Minerals and Geology on March 17, 2005. The Decision Date was set for June 15, 2005. An <br />error in excluding land to be used for asserting a different right of access required an <br />amendment to the application on April 27th, 2005. As required by Rule, the Decision Date was <br />moved to June 25th, 2005. <br />Currently the application proposes a surface sand /gravel extraction and materials processing <br />operation, located on 41.6 acres, 6.5 miles east of Montrose, Colorado in Section 36, Township <br />49 north, Range 8 west of the 10th Principal Meridian. A timely objection was received from the <br />Lazy A Corporation through its attorney on June 7th, 2005 one day prior to the close of the public <br />comment period of June 8`h, 2005. <br />The current land use is rangeland. The proposed site would be restored to rangeland on 20 foot <br />terraces per the accepted reclamation plan for the stated post mine land use. 3:1 slopes and <br />benches would be re-vegetated with a rangeland seed mix as each terrace is mined out. <br />All aspects of the permit application meet the requirements of the Construction Materials Rules <br />and Regulations. The re-submitted application was the final product of the original review and <br />went through a second review process to ensure compliance. <br />The Division of Minerals and Geology (DMG) hereby issues its recommendation for approval of <br />the Gray Pit #2 Sand and Gravel Mine application based on the fact that the application meets <br />all the requirements of CRS 34-32.5-101 to 125. <br />Office of Office of Colorado <br />Mined Land Reclamation ARive and Inactive Mines Geological Survey <br />To All Concerned Parties: <br />
