• III IIIIIIIIIIIII III • <br />MINED LAND RECLAMATION BOARD <br />Department of Natural Resources <br />1313 Sherman Street, Room 723 <br />Denver, Colorado 80203 <br />DEVELOPMENT AND EXTRACTION MINING PERMIT <br />Permit No. 78-162 <br />Telephone: 892-3567 <br />THIS PERMIT is .issued this 29th day of June by the Mined Land <br />Reclamation Board, Department of Natural Resources, state of Colorado. <br />W I T N E S S E T H <br />WHEREAS, Morgan County desires to conduct a(n) open pit mining <br />operation, known as Green Pit , for the purpose of extracting open pit <br />mined sand 6 gravel and <br />WHERI'.AS, on May 15 , 19 78 , Morgan County "FILED" an appli- <br />cation, a reclamation plan and map, and the required fee, as required by law; and <br />WHERIiAS, on June 29 19 78 , the Minc:d Land Reclamation Board approved <br />Morgan County's application and set bond; and <br />WliER1iAS, on June 29 , 1978 , the Mined Land Reclamation Board accepted surety <br />submitted by Morgan County acid such date shall be considered the <br />date of iusuance of the permit and the anniversary date Eor all other purposes; and <br />WHEREAS, the Mined Land Reclamation Board has made s finding, For the purposes <br />of isauir.g this permit, that: <br />1) the application complies with [he requirements of the Colorado <br />Mined Land Reclamation Act and all applicable local, state and <br />Federal laws; and, <br />2) the operation will not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there <br />is an agreement between the operator and the persons having ar. <br />interest in the structure that damage to the structure is to be <br />compensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in conformance with the requirements of C.R.S. 1973, 34-32-116, <br />as amended (1976 Sees. Laws H.B. 1065); and <br />WHEREAS, for the purposes of issuing this permit, the operator has made <br />a eatisf~tctory showing to the Board that he will employ during and after his <br />open fit mining operations procedures reasonably designed to minimize as me <br />as practcable the aLSruption from the open pit mining operations and •.~_',', <br />provide 1`or the rehabilitation of the affected land through the rehabilitation of Elant <br />cover, soil stability, water resources, and other measures appropriate to [he <br />subsequent beneficial use of such mined ar.d reclaimed lands; and t5 at in <br />the event of the failure of his proposed reclamation plan, he will take whatever <br />measures which may be necessary in order to assure the success of reclamation of <br />the land:c affected by hie open pit mining operations; and, <br />WHE;IEAS, for the purposes of Issuing this permit, a copy of the application <br />approved by the Mined Land Reclamation Board of the State of Colorado is attached <br />to this •~ermit and thereby becomes apart of the terms hereof. <br />NOW, THEREFORE, pursuant to the authority ae[ forth in the Colorado `tined <br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976 <br />Sess. Laos H.B. 1065) [he Mined Land Reclamation Board of the State of Colorado <br />hereby issues a life of the mine permit to Morgan County to engage in <br />open pit mining for the purpose of extracttng open pit <br />mined sand & gravel „n the following parcel of ground, to wit: <br />9.88 acres located in the SEi SWti Sec 24, Twn 6N Rge 56 W. <br />6th P.M., Morgan County, Colorado <br />
