Lochhead <br />Executive D~recmr <br />Michael B Long <br />RE: Sanborn Creek Mine; File No. C-81-022; Vegetation Study oiv ision olrecror <br />for Proposed Coal Waste Bank <br />Dear Mr. Hayes: <br />The Division has reviewed your request to forgo additional baseline <br />vegetation sampling for the soon to be proposed coal mine waste <br />pile at the Sanborn Creek Mine. Given the location (adjacent to <br />the reference area), vegetative composition (similar if not <br />identical to that of the reference area), and the small size of the <br />proposed disturbance (approximately 5 acres), the Division agrees <br />that additional sampling is not necessary to permit this waste <br />pile. Obviously, if a different vegetative community of sufficient <br />size other than mountain shrub or juniper woodland existed, <br />additional sampling would be necessary. <br />With respect to permitting, a qualitative description of the <br />existing vegetative community(s) to be disturbed along with <br />respective acreage breakdowns will suffice. The existing map may <br />need to be tweaked a little to better illustrate the vegetative <br />make-up of the locations to be disturbed. It also appears that the <br />reference area will need to be realigned to remove those portions <br />that may be affected during construction of the pile. The <br />remaining undisturbed reference area is large enough in size to <br />compensate for removing a small portion of the area. The final <br />item will be to propose a seed mix and success standards which I <br />suspect will follow those outlined in the existing permit. <br />If you have any questions or require additional information, please <br />contact me. <br />Sincerely,\ <br />Anthony J.
