C'.'3 ~~.
III IIIIIIIIIIIII'I' Wilhelm Property 11671 Brighton Rd Henderson, CO 80640
~, sss
June 23, 20000
DECEIVED
Colorado Division of Minerals and Geology
Mr. Carl Mount and Mr. Tom Schreiner Room 215 ill `. - 2QOU
1313 Sherman Street
Denver, CO 80203 u~ais!cn et l~firer2ls & Geology
Dear Sirs,
We have lived on this land for 30 years, we always had plenty of water which led to
having trees and green pastures and we have been able to raise crops.(Alfalfa and
gardens.)
Our water came from ocu irrigation well that is covered under Central's Plan for
Augmentation. Our permit # for 1999 was 013669F we have paid all of our fees and are
up to date. That is CCWCD 3209 West 28th Street, Greeley, CO 80634
.•.
We are writing to ask for your help. We began loosing water in our well do to mining in
the area. We were fine all the years that the pits were mining until they began to drain
their lakes. Now we cazi t use our well, our trees, and pastures are dying.
We had just replanted half of our land in 95 and now we are loosing all the new grass
along with the trees that were planted in 1977.
We also have pictures o1'times the pit's equipment broke our fences and times when they
piled soil that sloped into the fence high enough to leave only a foot of our post when
they usually aze 5 feet above ground. An easement to the back of the property has been
dug out to a drop off and in other areas has dirt piled on it.
We are only a small ]anti owner we are requesting the state to look out for our rights.
We desperately need animal feed to replace our lost pasture and water to try to save what
crop hasn't died.
We do have some water rights through Fulton Ditch but it too is not available due to a
pit. We need their cooperation in putting in a bigger covert and cleaning the ditch. This
would only water the lower area of our land it can't replace our lost ability to irrigate with
our sprinkler system to the higher pasture. Please look into this.
Jackie Wilhelm 303-287-1949
