Pursuant to Rule 2.02.2 the <br />Division must make three determinations regarding completeness, substantial <br />disturbance, and nature of the exploration project. <br />Accordingly, the Division finds that: <br />1. The proposed exploration drilling project, submitted as two documents <br />entitled "Exploration plan for Certain Unleased Federal Coal Lands" (10 <br />drill holes) and "Exploration Plan for Coal Lease C-023703" (3 drill <br />holes), will substantially disturb the natural land surface (as defined <br />by Rule 1.04(127)). <br />2. The proposed exploration drilling, project qualifies as a coal <br />exploration activity and not surface coal mining operations. <br />3. The proposed exploration drilling project plan is incomplete as <br />submitted, of the following information must be submitted. <br />A. Specific reference to (or actual copies of) documents conveying <br />information granting the legal right to enter from the BLM. <br />B. A plan addressing topsoil salvage and replacement at each drill <br />site. <br />C. A plan addressing mulching and/or other means to cover and <br />adequately protect the seed following reseeding operations. It is <br />recommended by the Division that the proposed seeding rate be <br />increased by at least 50 percent due to the arid climate of the <br />region. <br />D.
