A court <br />date scheduled for early May was continued for various reasons. In addition <br />to the scheduled court date, the Attorney General's office has informed me <br />that they are very close to reaching a settlement agreement with GEC that <br />would resolve the issue without the need to ao to trial. <br />We currently have b391,000.00 in escrow to do reclamation worK. The state has <br />also secured a judgement against GEC in the amount of E100,00U.00 through the <br />District Court in Fremont Countv. We nave been conducting regular inspections <br />of the site to ensure that no environmental or off site proolems are <br />occurring. The Division has developed a reclamation plan for the site and <br />will begin reclamation work as soon as the legal actions are resolved. <br />The Division has received a revision request from the Southfield mine to <br />incorporate of portion of GEC into their permit. if this revision is <br />ultimately approved by the Division and the Board, the state will have <br />adequate funds to reclaim the site. The revision must be approved by the <br />Board since GEC's permit has been revoked. <br />I feel confiaent that the GEC si Ovation will be resolved this vear.
